The Job

The Legal Counsel provides advice and counsel on a broad range of issues related to the operations of a Medicare Advantage health plan, and is responsible for preparing, negotiating, and reviewing vendor and provider contracts. The Legal Counsel will also provide advice and counsel on health information, privacy and security regulatory matters. The work is varied and complex, requiring a high degree of discretion, flexibility, and independent judgment, and is done with the highest level of ethics and integrity.

The successful candidate will have outstanding contracting skills, be an excellent communicator, an enthusiastic and curious learner, and can work autonomously on a variety of assignments and projects in a fast-paced, high-volume environment. The Legal Counsel should possess a strong drive for excellence, attention to detail, an ability to adapt to change, and a “can do” positive attitude. The position requires strong contracting experience and a general health law background.

The position is hybrid, with some on-site days per week (currently Tuesdays and Wednesdays) at SCAN’s headquarters in Long Beach, California.

You Will

  • Work collaboratively with members of the legal department to fulfill the legal, contractual, and regulatory obligations of the organization (specifically, health information, privacy and security matters).
  • Draft, review, advise, and negotiate a broad range of contracts, with a focus on vendor services (including SaaS, professional services, and consulting) and provider agreements (hospitals, primary care, specialist, ancillary providers, telehealth providers, etc.).
  • Provide advice and assistance to the Compliance department in drafting and responding to filings or inquiries from regulators (e.g. U.S. Department of Health & Human Services Office for Civil Rights, Centers for Medicare and Medicaid Services, California Department of Managed Health Care, and California Department of Health Care Services), and in ensuring compliance with statutory, regulatory, contractual and other requirements.
  • Conduct legal research and provide analysis on state and federal laws pertaining to health plans, medical groups, managed care, provider contracting.
  • Act independently to provide well-informed and timely legal advice on a variety of complex and sensitive healthcare matters.
  • Monitor and research market and industry trends of interest to the company in connection with its business activities. Anticipate changes impacting operations, notify management and recommend preparatory actions.
  • Work collaboratively with a broad range of stakeholders throughout the organization to develop and maintain strong relationships with SCAN business units and portfolio companies.
  • Actively support the achievement of SCAN’s Vision and Goals.
  • Other duties as assigned.

Your Qualifications

  • Required: Law Degree from an ABA accredited law school
  • Required: California Bar membership in good standing
  • 3-5 years of relevant legal experience at a reputable law firm and/or established health care company legal department.
  • Extensive experience negotiating, drafting, and interpreting commercial agreements.
  • Experience providing managed care legal advice to health plans and/or providers preferred.
  • Knowledge of federal and state healthcare law related to managed care, Medicare Advantage, HIPAA, Fraud Waste and Abuse (e.g., Stark, Anti-Kickback Statute) preferred.
  • Strong organizational skills; ability to multitask while maintaining attention to detail.
  • Ability to appropriately maintain confidentiality.

Strong legal research, analytical, and critical thinking skills required.

Personal presence and the professional demeanor needed to work with all levels of individuals throughout the organization.

The ability to collaborate as team player and to adapt to change, master new skills, and assume additional responsibilities as needed.

Practical and business oriented with sound judgment and the ability to work well in a fast-paced team environment. Able to balance competing priorities.
