Overall Purpose

This position will serve as lead legal counsel and strategic adviser to our regulated business unit that provides leading consortium-based solutions that help financial institutions manage fraud and risk, improve customer experiences, and meet regulatory obligations while providing a host of financial services in brick-and-mortar and digital experiences. This role will provide leadership, advice, and guidance on a broad range of legal matters arising in the business. Additionally, this role will provide subject matter expertise and advice on the Fair Credit Reporting Act (FCRA) and the Gramm-Leach-Bliley Act (GLBA), which are of foundational importance to the business unit, and advise on complex data risk issues. This position will be an integral part of the broader legal team providing comprehensive legal support to the entire company.

Essential Functions
  • Independently provide business-focused legal advice on all manner of legal matters and risks impacting the business.
  • Independently manage day-to-day legal activities for the business unit, such as marketing material review, product documentation review, policy and procedure review and development, advising on development and application of consortium operating rules, supporting business unit advisory committees, and addressing consumer support inquiries.
  • Provide FCRA legal interpretations and advice on business-critical initiatives, on issues concerning furnishers and users of consumer reports, and on issues pertaining to consumer reporting agencies.
  • Provide legal and strategic advice and guidance on issues related to consumer data collection and use under GLBA, other privacy laws and evolving data-sharing regulatory frameworks.
  • Provide legal support to data risk management functions (includes privacy, data governance, model risk management and records management).
  • Provide business-oriented and strategic legal advice and support to the business team regarding compliance with laws and regulations and new initiatives.
  • As needed, draft, review and negotiate a variety of commercial relationships supporting the business unit, including strategic partnerships, sales, and supplier agreements.
  • Function as department expert in the context of audits, litigation, regulatory investigations and exams and other legal proceedings affecting the business unit.
  • Work with Government Relations team to monitor legislative and regulatory developments, evaluate their potential impact on the business and advise Compliance and business partners with respect to legal requirements arising from new or changes to existing laws or regulations.
  • Effectively partner with Legal, Compliance, Privacy, and Risk department personnel to provide seamless support to the business unit.
  • Instruct and manage outside counsel on specialized advice as needed.
  • May manage and supervise lower-level attorneys and/or other legal personnel.
  • Support the company’s commitment to risk management and protecting the integrity and confidentiality of systems and data.
Minimum Qualifications
  • Juris Doctor from accredited law school; active admission to a state bar.
  • At least eight years’ experience as in-house counsel or in a law firm, with strong background advising clients on consumer financial services laws.
  • At least three years’ experience advising on the FCRA.
  • At least three years’ experience advising on the GLBA.
  • Ability to learn new substantive areas of the law quickly.
  • Experience working with regulators and/or in federal supervision, investigation, or enforcement matters.
  • Ability to identify, analyze and resolve unique and complex legal issues.
  • Ability to think strategically and give practical advice with imperfect information.
  • Ability to work independently as well as collaboratively to achieve business objectives.
  • Strong presentation skills and excellent written and verbal communication skills.
  • Ability to draft clear, concise, and accurate legal positions to internal clients at all levels of the organization.
  • Strong interpersonal and collaborative skills to build partnerships and alliances internally and with external partners at all levels of the organization.
  • Strong business acumen—the ability to be forward-thinking and innovative while understanding our business needs and limitations.
  • Organized with ability to manage multiple competing priorities in a fast-paced environment.
  • Prior experience effectively managing outside legal resources.
  • Unyielding commitment to highest professional ethics.
  • Ability to maintain professional licensing and memberships in appropriate professional organizations.
  • Background and drug screen.
Preferred Qualifications
  • Familiarity with antitrust laws.
  • Additional related education and/or experience preferred.
  • Prior experience/knowledge regarding covered areas preferred.
Physical Requirements

Working conditions consist of a normal office environment. Work is primarily sedentary and requires extensive use of a computer and involves sitting for periods of approximately four hours. Work may require occasional standing, walking, kneeling, and reaching. Must be able to lift 10 pounds occasionally and/or negligible amount of force frequently. Requires visual acuity and dexterity to view, prepare, and manipulate documents and office equipment including personal computers. Requires the ability to communicate with internal and/or external customers.

The Pay Scale For This Position In

Phoenix, AZ/Chicago, IL in USD per year is: $240,000-260,000.

San Francisco, CA/New York in USD per year is: $260,000-280,000.
