Restaurant/Retail Insurance Defense Associate

*Onsite for the first 90 days with hybrid potential after the 90 days*


As a Restaurant/Retail Insurance Defense Attorney specializing in arbitration expertise on the defense side, you will be entrusted with representing clients within the restaurant and retail sectors, including businesses such as retail electronic stores (handling service calls), gyms, grocery stores, restaurants, and retail clothing stores. The candidate's primary role will involve providing legal counsel and defense strategies to these clients, particularly in insurance claims and disputes. Our clients comprise businesses, insurance companies, and individuals. You will conduct comprehensive insurance claims assessments, investigate incidents, and evaluate liability within the restaurant and retail environments. The candidate's expertise in arbitration will be necessary in facilitating alternative dispute resolution processes, such as negotiation and mediation, to resolve disputes efficiently and favorably for our clients. With regard to the retail electronic store client and given the nature of our client's preferences for dispute resolution, we are particularly interested in candidates with expertise in arbitration. In representing our retail client, the attorney must comprehensively understand arbitration agreements. Our client has a dispute resolution clause in place and would prefer to avoid the complexities of the court system whenever possible. Therefore, the selected candidate must possess a deep understanding of the inner workings of arbitration, including familiarity with relevant laws, procedures, and strategic approaches. Of particular importance is the ability to navigate situations where a plaintiff initiates court proceedings despite the existence of a dispute resolution clause mandating arbitration. The ideal candidate will demonstrate proficiency in asserting and defending against motions to compel arbitration, ensuring that our client's interests are effectively represented. While arbitration is often preferred, litigation experience is still valuable. The candidate should have a track record of success in court proceedings, including motion practice and trial advocacy.

  • Foodborne Illnesses - Contamination or mishandling of food leading to illnesses such as food poisoning.
  • Burns and Scalds - Accidents involving hot surfaces, liquids, or cooking equipment in the kitchen area.
  • Fires - Kitchen fires or electrical fires can occur due to faulty equipment or improper maintenance.
  • Chemical Spills - Accidental spills of cleaning chemicals or other hazardous substances that can cause injuries or environmental damage.
  • Equipment Malfunctions - Machinery or equipment failures in the kitchen or retail space, leading to accidents or injuries.
  • Trips on Obstacles - Tripping over items left in walkways, such as boxes, cords, or inventory.
  • Structural Failures - Collapses or failures of structures within the building, such as ceilings, shelves, or fixtures.
  • Assaults and Altercations - Incidents involving altercations between customers or between customers and staff, including cases of assault or harassment.
  • Allergic Reactions - Serving food containing allergens to customers with allergies, leading to allergic reactions.
  • Slips on Wet Surfaces - Spills or leaks leading to slippery floors, causing slips and falls.
  • Transportation Accidents - Accidents involving delivery vehicles or transportation services associated with restaurant and retail operations.
  • Pay range will be from 115k – 150k and candidates must have an active bar license in the state of Tx.
