Property & Licensing Manager

Austin Powder is seeking an energetic, detailed oriented individual who is passionate about compliance, enjoys working across many platforms and is extremely detailed. This role requires a dynamic and results-driven manager who is self-motivated, has a proven track record of success preferably in the mining, quarrying, earth moving or construction industry who has strong communication skills, a deep understanding of regulations and is collaborative in nature. This position works closely with field management and other corporate departments to support compliance of ATF regulations as well as state, local and other governing agencies and site landowner requirements.

The position is responsible for developing reference documents and oversees the day-to-day field support of Business Application Specialists. In this role The Property and Licensing Manager reports to the Director of Corporate Operations.

ESSENTIAL DUTIES AND RESPONSIBILITIES

  • Standard Operating Procedures (SOPs) - Develop, publish and maintain department SOPs to assist in the ongoing documentation of the duties and responsibilities of the Operations Department.
  • Change in License/Corporation structure - From time to time, Austin Powder's LLC structure may change geographically. Prior to corporate structure changes being made, the ATF must approve the restructure and understand the change in RPs, if applicable. The Property and Licensing Manager will lead the Restructure Project.
  • The Property and Licensing Manager will also be responsible for notifying other Austin Powder departments (tax, human resources, risk, accounting, IT, credit) of the changes and work to ensure a timely accurate transition of final and beginning inventories, and necessary state tax filings. Changes in structure hierarchy and GL cost centers may also impact accounting and human resources systems.
  • Properties - Works directly with field management and property owners to support the negotiations of property site leases and renewals, land acquisitions and sales. The position is responsible for tracking and processing lease transactions, such as rent payments, renewals, taxes, and property expenses.
  • Property Issues

  1. State and local permits - storage permits; permits to sell explosives.

  • Property Assets - Bins, Magazines, Fuel Tanks
  • Property Lease Payments - Monthly, Quarterly, Annually
  • Site Plans
    • The Property and Licensing Manager works directly with LLC's Responsible Person (RP) to update site plans, with RP notifying ATF as required. This involves maintaining current information on site layouts and assets in compliance with ATF Table of Distances, identifying inventory storage magazines, trailers and bins by type, class, construction and capacity and creating magazine recap sheets. Inventory storage magazines on site plans must match magazine identifications in Linus DSMT. Austin Powder has more than 800 storage assets.

  • ATF/ERD License Applications and Renewals
    • The Property and Licensing Manager is also responsible for coordinating field documentation and information to submit for ATF license application renewals. Property and Licensing Manager will familiarize and stay abreast of ERD regulations, in order to support Canadian Operations with licensing and renewal. ATF licenses have a 3-year expiration; ERD licenses expire each year.

  • ATF Responsible Persons
    • When employees designated as Responsible Persons (RP) are hired, termed or transferred, Austin Powder must notify ATF of the change within 30 days. RPs must submit fingerprints to the ATF. The Property and Licensing Manager is responsible for notifying the ATF of the changes and submitting documentation for newly appointed RPs.

  • Notice of Clearance (NOC)
    • Austin Powder submits employee changes (hires, terms, transfers) to the ATF on a weekly basis. The ATF runs background checks and if vetted, places the individual on a Notice of Clearance. The ATF sends the NOCs to Cleveland. The Property and Licensing Manager is responsible for the review of the NOCs to ensure that the ATF has updated them appropriately. The NOCs are posted to Lease Harbor and also forwarded to the APC location.

  • ATF Compliance
    • ATF Federal Explosives Law and Regulation, generally known as the "Orange Book" ensures the safe and secure storage of explosives. The Property and Licensing Manager must read and be able to reference and adhere to the guidelines at all times. Should any concern arise with regard to our interpretation and practice of the regulations, the Director of Operations must be notified immediately.

  • ATF Variance & Requests
    • ATF requires variance requests be submitted for review when, for safety or efficiency's sake, an allowance to work outside of a specific ATF regulation is sought. The Property and Licensing Manager will oversee and assist in draft of variance request. Upon approval, Property and Licensing Manager will record/maintain variance in Lease Harbor.

  • ATF Procedural Guide
    • Austin Powder developed an ATF Procedural Guide that provides specific guidance and direction to field management regarding ATF responsibilities. The Property and Licensing Manager will work with the Training Department and be responsible for the ongoing accuracy and update of the ATF Procedural Guide.

  • ERD Procedural Guide
    • Austin Powder is working toward implementing company-wide best practices when no regulatory directive exists. In 2020 Austin Powder plans to introduce the biweekly inventory reconciliations throughout Canada. An ERD Procedural Guide will be created to document standard operating procedures.

  • ATF/ERD Inventory Schedules
    • Establish and publish the ATF/ERD biweekly and annual inventory schedules in December of each year.

  • Inventory Audits
    • Monthly review of inventory quantities against assets. Contact field when inventory adjustments are necessary, including bulk and gassing chemicals.

  • Software/Systems
    1. Lease Harbor/Harbor Flex. The Property and Licensing Manager must accurately maintain all ATF license and application data.
      • ATF Application with site plans and mag worksheets
      • Key magazine, bin and fuel storage assets
      • ATF Letters of Authorization with Key dates
      • ERD Licenses. Saved to network, upload to Lease Harbor with key dates.


    2. Linus - The Property and Licensing Manager participates as part of an ongoing Linus support initiative to ensure compliance and efficiencies with inventory recordkeeping requirements. Position provides support to users in a help-desk fashion. The Project Manager also participates in Linus improvement projects and supports initiatives to improve compliance or operational efficiencies.
    3. IMESAFR - The Property and Licensing Manager is trained following one year experience on the job in IMESAFR, a quantitative risk analysis tool. Each APC location must have a current IMESAFR analysis completed and revised when storage capacity changes are presented by field management. Training held at APT Research in Huntsville, AL.
    4. Infinium - Access to employee information for ATF License renewals.


  • Manage/Supervise Business Application Specialists

Provide support and resources to staff. Prioritize tasks and project lists. Provide informal and formal feedback on job performance, goals and developmental opportunities. Promote cross-training in support of Operations Department needs. Ensure collaboration with others throughout the company, when needed.

EDUCATION AND EXPERIENCE

  • Bachelor's degree or equivalent work experience in Business Administration.
  • Experience working in a multi-state, multi-facility environment required.
  • Supervisory experience with increasing level of responsibility is preferred.
  • Prior experience working with Microsoft Office suite.
