As In-House Legal Counsel for BEYOND Hospitality Group Inc., you will be an integral part of the legal team contributing to the seamless execution of our overall legal strategy from our office in Miami and ensuring legal compliance in a dynamic and fast-paced environment. This role requires a legal professional with a strategic mindset, excellent communication skills, and a comprehensive understanding of commercial contracts, litigation, and US employment, compliance, contract, and regulatory practices.

You will provide direct legal support across a broad spectrum of legal issues, particularly guidance on all areas of the company business, including, but not limited to, contentious and non-contentious commercial contracts, brand protection, data protection, digital data rights, rental agreements, US immigration matters, employment contracts, and coordination with internal stakeholders on general compliance.

In addition to the primary focus on the United States company, this role entails a global perspective, reflecting BEYOND's international presence. As a Legal Counsel, you may be called upon to provide legal expertise to cover commercial aspects outside of the company's operations in the USA.

Key tasks and responsibilities

  • Diligently, timely, and efficiently carry out duties assigned by the project manager and your immediate line manager of any projects you may be involved in.
  • Copy the project manager specific to the subject of the correspondence and your line manager on all mail sent out.
  • Provide your full support to BEYOND Hospitality Group Inc. in meeting deadlines that require your input and expertise.
  • Manage telephonic and consultative queries and respond to information requests and legal inquiries.
  • Partner with Employee Relations (HR) on company investigations as they arise.
  • Manage and treat all matters of a confidential nature, oral or written, with tact and discretion.
  • Follow all policies and procedures related to absence, sickness, business travel and expenses, and antibribery, ensuring compliance within the agreed timeframe and alignment with the company handbook, code of conduct, and core values.
  • Adhere to US Federal, state, and local laws, regulations, and practices set forth by the bar of Florida.
  • Engage in the nuanced review and drafting of various contracts with customers, encompassing terms of sale for hospitality, accommodation, ticketing, and other services.
  • Draft, review, and negotiate various commercial contracts with suppliers and service providers in relation to catering services, hostess services, rental and supply agreements.
  • Provide legal advice on the complexities of insurance policies related to events and provide comprehensive legal oversight.
  • Review the terms and conditions of various insurance policies.
  • Condense lengthy and complicated documents, extracting essential information to present to senior management for efficient decision-making.
  • Address pre-event and post-event customer and consumer queries and cases, applying a strategic legal approach to find optimal resolutions.
  • Draft sophisticated and high-level correspondence, ensuring clarity and precision in formal communications.
  • Oversee pre- and post-contract litigation matters when they arise.
  • Attend meetings with operational heads and third-party contractors, providing legal support, insights, and guidance during negotiations.
  • Ensure that the company’s business activities are in compliance with US Federal, State, and Local laws.
  • Stay abreast of changes in US laws, particularly in Consumer, Employment, and Health and Safety Laws, disseminating crucial updates within the legal department.
  • Draft and review employment documents (including, but not limited to, contracts and internal policies) that align with legal standards, best practices, and applicable law.
  • Provide advice on various employment relations and labour government compliance inquiries in partnership with the HR Director and the company’s stakeholders.
  • Ensure the company's adherence to all Federal, State, and Local employment laws.

Professional skills

  • Attended a fully accredited law school and is actively admitted to the Bar of Florida with no restrictions.
  • 4-7 years of legal practice PQE in an in-house legal department or a reputable law firm working with business clientele.
  • Proven experience in drafting contracts, revising, and negotiating, with a comprehensive understanding of legal procedures, litigation, consumer, employment, and civil laws.
  • Proven expertise in legal research.
  • Strong knowledge of United States, Federal, State, and Local law and regulations, focusing on contract law and corporate governance.
  • Excellent drafting, negotiation, communication, and analytical skills.
  • Ability to provide and communicate practical and solutions-based legal advice.
  • Ability to work collaboratively in a fast-paced, dynamic environment.
  • Ability to work independently, exhibiting self-reliance and proficiency without constant supervision.
  • Ability to handle a large workload and set priorities.
  • Proficient in Word, PowerPoint, and Excel.
  • Ability to travel across the USA when required.

Physical work environment

  • Miami, Philadelphia, and Mexico City Office with travel as needed.

General

  • Working hours are 08:30-5:30 pm, Monday-Friday EST; however, due to the nature of our work, you may be required to work after hours and weekends as needed.
  • You may be required to assist with other tasks when needed.
  • The nature of this work may require amendments or additions to responsibilities as we approach significant events.
