Our US IP litigation docket is poised to grow by 50% in 2023 and will double in 2024. We are looking for an experienced, intellectually curious litigator to join our team and drive Sandoz’s transformational growth journey.

The IP Counsel / Senior IP Counsel will function as a key IP advisor to the business and will assist in driving company growth by developing and implementing innovative litigation strategies to secure first to market launches. This role will collaborate with the Global IP team, in particular the Global Patent Attorneys, to support the development of products in a manner that optimizes the launch of those products in the US.
Major accountabilities include, but are not limited to:
- Seamless cooperation and collaboration with the Global Patent Attorney and global product development team for each product, ensuring that each product developed for the US market has a robust US IP litigation strategy at, or shortly after, the product is put on stability trials, and that the regulatory submission is optimized for US litigation.
- Supervise and manage ANDA, 505(b)(2) and biosimilar patent litigations, including driving strategy and budgets with outside counsel and partnering with key internal stakeholders.
- Provide clear and direct expert counsel on Hatch-Waxman and related patent, regulatory, exclusivity and forfeiture issues, including developing innovative strategies to maximize growth in a clear manner for non-IP experts.
- Maximize the value of Sandoz’s IP litigations by developing an overall strategy for producing successful litigation results or settlements, and then using all available resources, such as patent certifications, notice letters and detailed statements, discovery techniques, witnesses and expert selections, etc., to support the strategies.
- Negotiate and draft settlements in Sandoz’s patent litigations in line with corporate objectives.
- Support and advise patent attorneys globally on key US IP litigation issues, training and advice.
- Ensure that the IP risk and strategy for any given product is well understood and documented, and that all launches at risk have the appropriate approval and support.
- Coach colleagues across all functions to improve US litigation expertise within Sandoz globally.
The pay range for this position at commencement of employment is expected to be between $201,600 and $302,400 per year; however, base pay offered may vary depending on multiple individualized factors, including market location, job-related knowledge, skills, and experience. The total compensation package for this position may also include other elements, including a sign-on bonus, restricted stock units, and discretionary awards in addition to a full range of medical, financial, and/or other benefits (including 401(k) eligibility and various paid time off benefits, such as vacation, sick time, and parental leave), dependent on the position offered. Details of participation in these benefit plans will be provided if an employee receives an offer of employment. If hired, employee will be in an “at-will position” and the Company reserves the right to modify base salary (as well as any other discretionary payment or compensation program) at any time, including for reasons related to individual performance, Company or individual department/team performance, and market factors.

Role Requirements
Education
- J.D. degree from a recognized, accredited U.S. law school and a license to practice in at least one state or the District of Columbia is required.
- An undergraduate or graduate degree with a specialization in Chemistry, Biochemistry, Biology, Biomedical Engineering, Chemical Engineering or similar discipline is preferred.
Work Experience
- For an IP Counsel, a minimum of 6+ years of Litigation experience in the pharmaceutical industry or with a Law firm specializing in complex Intellectual Property litigation matters is required.
- For a Senior IP Counsel, a minimum of 8+ years of Litigation experience in the pharmaceutical industry or a Law firm specializing in complex Intellectual Property litigation matters is required.
- Substantial experience litigating ANDA cases and handling Hatch Waxman issues is required.
- Energetic self-starting personality with strong executive presence, results oriented and proven ability to be effective in a fast-paced and highly demanding environment.
- Proven judgment in working through complex issues, including those with significant strategic risk to the company.
- Ability to independently manage complex projects and provide oversight for cross-functional project teams by collaborating and setting strategic priorities to accomplish organizational goals.
- Fluency in English required, along with exceptional presentation and communication skills.
This opportunity is located at the Sandoz Princeton, NJ site, and will not have the ability to be located remotely.
